Who we are
Swift Web Dev is a WordPress development studio owned and run by Rasel Hakkani, based in Gaibandha, Bangladesh. In these terms, “we”, “us” and “our” mean Swift Web Dev. “You” means the person or business that uses our software.
These terms cover our software products: the SwiftWebDev Dashboard & Analytics plugin, the SwiftWebDev Dashboard PRO add-on and the SwiftWebDev Dashboard service at swdashapi.swiftoutbox.com that both use. By installing, activating or buying any of them, you agree to these terms.
The free SwiftWebDev Dashboard plugin
SwiftWebDev Dashboard is free software, licensed under the GNU General Public License version 2 or later. You can use it on as many sites as you like, change it and share it under that license.
The free plugin works on its own. Its speed tests use our online service, so section 07 also applies to them.
SwiftWebDev Dashboard PRO licenses
SwiftWebDev Dashboard PRO is sold as a yearly license. A license gives you access to the Pro add-on, the Pro features of our online service and updates, for as long as the license is active.
- Site limits: each plan covers a set number of sites: 1 site, 5 sites or unlimited sites. You can move a license by deactivating it on one site and activating it on another.
- Your key is for you: use your license key only on sites you own or manage. Keep it private.
- No resale: you may not sell, rent, share publicly or give away license keys.
If a key is shared, resold or used beyond its plan, we may deactivate it.
What a license does not include
A SwiftWebDev Dashboard PRO license covers the software only: the Pro add-on, the Pro features of our online service, updates and email support for the plugin. It does not include WordPress development, design, installation, customization, maintenance or any other service performed by Swift Web Dev. Those services are separate, are agreed in their own written quote and are invoiced separately, never through the SwiftWebDev Dashboard PRO checkout. Buying a license does not entitle you to them.
How you get your key
We do not send license keys by email. After you buy, Creem emails your receipt and we email an order confirmation. You then sign in to your account page with the email you used at checkout, through a one-time sign-in link. There you can show and copy your key and download SwiftWebDev Dashboard PRO.
If your key leaks, generate a new key in your account. The old key stops working at once, and sites that use it are deactivated until you activate the new key.
Payments through Creem
Our orders are processed by Creem (creem.io), which is the merchant of record for all SwiftWebDev Dashboard PRO purchases. This means Creem sells the license to you on our behalf, takes the payment, adds any VAT or sales tax at checkout where applicable, and sends your receipts and invoices. We never see your card details.
Yearly prices: Personal $25 for 1 site, Business $100 for 5 sites, Unlimited $299 for unlimited sites.
Creem’s buyer terms also apply to your purchase.
Automatic renewal and cancellation
Your license renews automatically at the end of each yearly term, and Creem charges the payment method you used. You can cancel at any time before the renewal date: use Manage billing on your account page, the link in your Creem receipt, or contact us. Cancelling stops the renewal, and your license keeps working until the end of the year you paid for.
When you cancel, your license stays active until the end of the term you paid for. After that it expires:
- Pro data collection and session recording stop on the day the license expires.
- We keep your stored Pro data for 30 days. If you renew within 30 days, it all comes back.
- After 30 days without renewal, we delete that data.
The free plugin keeps working after a Pro license ends.
Refunds
If SwiftWebDev Dashboard PRO is not right for you, ask for a refund within 14 days of purchase and we will refund you in full through Creem.
- How to ask: use our contact page or email [email protected] with your order details.
- Renewals: a renewal charge can be refunded within 14 days of that charge.
- Upgrades: an upgrade charge can be refunded within 14 days. Your license then returns to your previous plan.
- After a refund: the license is deactivated. Creem sends the money back to your original payment method.
Our refund policy has the full details.
The online service
The SwiftWebDev Dashboard service at swdashapi.swiftoutbox.com does two jobs:
- Speed tests for the free plugin and SwiftWebDev Dashboard PRO. You can test any page of your site. The service checks that the page belongs to your site, then asks Google PageSpeed Insights to test it.
- Analytics collection for SwiftWebDev Dashboard PRO, which starts only after a license is activated on your site.
Provided as is
We work to keep the service running well, but we provide it “as is” and “as available”. We do not promise that it will always be available, fast or free of errors. We may change or improve features over time.
Fair use and rate limits
The service has limits so it stays fast for everyone. For example, speed tests are rate limited per site, and SwiftWebDev Dashboard PRO allows up to 10 speed tests per 10 minutes. Only pages on your own site can be tested.
Suspension for abuse
We may limit, suspend or end access for any site or license that abuses the service. This includes trying to get around rate limits, testing sites that are not yours, overloading the service, sharing or reselling keys, or using the service for anything illegal.
Your data
The free plugin keeps visitor counts in your own WordPress database. Speed tests send your site address and the tested page address to our service. For the free plugin, the service does not save the results; it keeps them in memory for up to 10 minutes to answer repeat tests. With SwiftWebDev Dashboard PRO, your site sends visitor events to our server, where we process them for you to show your reports, and we keep your speed test history there. You stay in control of that data, and we only use it to provide the service.
Our privacy policy explains exactly what we collect, how long we keep it and your rights.
Your responsibilities
- Tell your visitors. You are responsible for the privacy policy, cookie notice and consent your own visitors need where the law requires them. This matters most for session recordings, which can need visitor consent in some countries. Check this before you turn recordings on.
- Use it lawfully. Use our software and service only in ways that follow the laws that apply to you and your site.
- Keep your key safe. You are responsible for activity under your license key.
No warranties
To the extent the law allows, our software and service are provided without warranties of any kind, whether express or implied. This includes warranties that they are fit for a particular purpose, will meet your needs or will work without interruption. Speed scores come from Google PageSpeed Insights and can change from test to test.
Limitation of liability
To the extent the law allows, we are not liable for any indirect or consequential loss, such as lost profits, lost revenue or lost data. Our total liability for any claim about our software or service is limited to the amount you paid us for your SwiftWebDev Dashboard PRO license in the 12 months before the claim. If you only use the free plugin, that amount is zero.
Nothing in these terms limits any rights you have under consumer law that cannot be limited.
Changes to these terms
We may update these terms as our products change. When we do, we update the date at the top of this page. If a change is significant, we will tell license holders by email before it takes effect. If you keep using our software after a change, you accept the new terms.
Governing law
These terms are governed by the laws of Bangladesh. Any dispute about them is handled by the courts of Dhaka, Bangladesh.
If you are a consumer, you keep any rights under the laws of your country that cannot be excluded by agreement.
